MagiCap Terms of Service

These Terms of Service ("Terms") govern your use of MagiCap ("the App"), developed by SoftCrunch Labs ("we", "our", or "us"). By downloading, installing, or using MagiCap, you agree to these Terms.

1. Eligibility

MagiCap is rated 4+ on the App Store and is available to users of all ages. By using the App, you confirm that you have the legal capacity to agree to these Terms, or that a parent or guardian has agreed on your behalf.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use MagiCap on Apple devices that you own or control, subject to the Apple Media Services Terms and Conditions. All rights not expressly granted to you are reserved by SoftCrunch Labs.

3. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Redistribute, sublicense, or sell the App or any part of it
• Use the App for any unlawful purpose
• Attempt to bypass security measures, rate limits, or subscription verification
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App to generate content that is illegal, harmful, abusive, or violates third-party rights
• Attempt to manipulate or inject instructions into the AI caption generation system

4. AI-Generated Content

Captions generated by MagiCap are produced by OpenAI's artificial intelligence models. You acknowledge that:

• AI-generated captions may not always be accurate, appropriate, or suitable for your intended use
• You are solely responsible for reviewing and editing captions before sharing them
• We do not guarantee that generated captions will be free from errors, bias, or unintended content
• Generated captions are provided for personal, non-commercial social media use
• Your photos and prompts are processed by OpenAI's API, subject to OpenAI's terms and data policies

5. Subscriptions and Pricing

Free Tier:

• Unlimited caption generation by watching rewarded ads
• One free caption generation without ads
• Standard AI model (GPT-4o-mini)

MagiCap Pro:

• Weekly: $4.99 USD/week
• Yearly: $19.99 USD/year
• Includes a 3-day free trial with full Pro access
• No advertisements
• Premium AI model (GPT-4.1-mini)
• 100 captions per day soft limit

Auto-Renewal:

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation:

You can cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription period.

Free Trial:

The 3-day free trial provides full Pro access. If you do not cancel before the trial ends, your subscription will automatically begin and your Apple ID account will be charged.

Price Changes:

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing period after notice.

6. Advertisements

Free users will see advertisements served by Google AdMob, including banner ads and rewarded video ads. Ad content is provided by third-party ad networks and we do not control or endorse the content of advertisements displayed.

7. Intellectual Property

The App, including its design, code, graphics, and branding, is owned by SoftCrunch Labs and protected by copyright and intellectual property laws. Captions generated through the App are provided for your personal use.

8. Privacy

Your use of MagiCap is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

MagiCap is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• AI-generated captions will meet your requirements or expectations
• Defects will be corrected in a timely manner
• The App will be compatible with all devices or operating system versions

10. Limitation of Liability

To the maximum extent permitted by applicable law, SoftCrunch Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claims arising from your use of the App shall not exceed the amounts you have paid to us in the six (6) months preceding the claim. For free users, our maximum liability is zero.

11. Third-Party Services

MagiCap integrates with third-party services including OpenAI, Google (Firebase, AdMob), AppsFlyer, and Apple (CloudKit, StoreKit). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or third parties.

You may stop using the App at any time by deleting it from your device and cancelling any active subscription.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the courts of Alberta, Canada.

Electronic Consent and Agreement

By downloading, installing, accessing, or using MagiCap, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Your electronic consent constitutes a legally binding agreement.
